Scott McNair Balcomb, Attorney for Glenwood Springs, CO
Scott is a former partner at Balcomb & Green who retired in 2016. He began working for the firm under its former name of Delaney & Balcomb, together with his father, Kenneth Balcomb, in 1972. Kenneth was heavily involved in water resource issues throughout the West, serving as principal counsel in cases that established the jurisdiction of state courts to adjudicate water rights for the United States.

From 1971 through 1982 Scott was heavily involved in interstate water issues, working alongside his father as general counsel of the Colorado River Water Conservation District. Between 1972 and 2000 Scott participated in hundreds of Colorado water court proceedings involving all types of water use. From 2001 – 2008 Scott served as Upper Colorado River Commissioner and the Governor’s Representative for the Seven States “Group,” where he was principally responsible for protecting Colorado’s position on the Colorado River with respect to water rights.

Scott earned his undergraduate degree in English at Dartmouth College in Hanover, New Hampshire in 1969. His time “back East” only confirmed his love of the Western part of the country, and particularly Colorado. He only applied to one law school, the University of Colorado Law School, which he attended from 1969 to 1972.

Sara M. Dunn

Sara is a partner at Balcomb & Green. She has extensive water law experience and can assist with the development and appropriation of new water rights; leasing, buying and selling of water rights; easement issues; and the management, protection and maximization of water resources. She also advises clients regarding water issues that arise in the course of real estate transactions and land use applications. Outside of the area of water law, Sara advises agricultural producers, commercial investors, financial institutions, special districts, individual businesses, homeowners associations, and landowners in a variety of matters

Sara earned her undergraduate degree from Colorado State University and her law degree from the University of Colorado Law School in 1998. She began her legal career as a law clerk for the Honorable Jonathan W. Hays in the 19th Judicial District. She also served as a part-time Water Referee in Water Division 1. Her passion for water rights developed while working with Judge Hays on complex water issues. Before joining Balcomb & Green, Sara developed a specialized water practice that includes a diverse client base throughout Colorado.

Sara is a Colorado native. She was born in Alamosa and was raised in southeastern Colorado working on her family’s wheat farm. Sara moved to the Roaring Fork Valley in 2000.

Rob is a partner at Balcomb & Green, and the co-chair of Worrell . Durrett . Gavrell, the firm's litigation division. His practice focuses on real estate and land use litigation, contract disputes, business litigation, personal injury claims, malpractice claims, homeowner and HOA litigation, and appeals. He also has a secondary practice in domestic relations and family law.

Rob prides himself on having a flexible practice that makes him uniquely suited to the demands of a region as varied as the Roaring Fork Valley. Rob handles boundary disputes, contract disputes, shareholder disputes, construction litigation, and trust and estate litigation. He represents a number of homeowners associations, and he represents individuals in disputes with their own homeowner associations. He also deals in tort law, and he has represented vehicle and truck accident survivors and personal injury victims by filing negligence claims, medical malpractice claims, realtor malpractice claims and even attorney malpractice claims.

Originally from the East Bay in California, Rob has lived at various times in New York, NY, and New Haven, CT. After traveling the world in 1997, Rob moved to Denver in 1998, and then to the Roaring Fork Valley in 2005. Rob has been specializing exclusively in litigation since 2007, and served two terms as a Vice President of the Colorado Bar Association from 2009 to 2011.

When not working for his clients, Rob enjoys inbound and back-country skiing and snowboarding, rafting, biking, mountaineering and off-roading. Rob completed climbing all of Colorado's 14ers in 2014.

Chris is a partner at Balcomb & Green who, after several years of general practice, focuses primarily on Colorado water rights and related real estate matters. He routinely assists in the acquisition, planning, and development of water supplies for clients, including ski areas, real estate developers, municipalities, water conservancy districts, special districts, ditch companies, owners' associations, and individuals. Chris also assists clients in navigating local, Colorado and federal land use and environmental permit requirements applicable to construction and operation of water facilities and other real estate development. He frequently works with clients, real estate professionals, and other attorneys to evaluate and negotiate the purchase of water rights associated with real estate. His practice also includes estate planning, landlord/tenant matters, and real estate transactions.

Chris obtained his undergraduate degree from Colorado State University in 1995 and joined Balcomb & Green in 2000 after graduating from the University of Colorado, School of Law. He grew up in Colorado Springs and the Denver metropolitan area and worked as a construction manager in Parker Colorado for several years between undergraduate and law school.

Chris is highly involved in the community. Chris is the 2016 chairperson of the Executive Council for the Water Law Section of the Colorado Bar Association, sits on the Board of Directors of Junior Achievement of the Roaring Fork Valley, is a past president of the 9th Judicial District Bar Association, and is actively involved in construction and maintenance of local soft-surface hiking and biking trails.

Erika Gibson

Erika joined the firm in 2016 as an associate in the water law division. She earned her B.A. from Columbia University in 2005 and her J.D. from the University of Oregon School of Law in 2015. During law school, Erika served as an executive editor for the Journal of Environmental Law and Litigation. She clerked in Washington, D.C. with the U.S. Department of Interior and the U.S. Department of Justice, where she worked on federal Indian groundwater rights and Clean Water Act issues.

Born and raised in Denver, Colorado, Erika has maintained a professional interest in western resources and politics. She has volunteered on farms, worked on salmon habitat restoration projects, and interned for the U.S. Senate Majority Leader as well as the Oregon Senate President Pro Tempore. From 2009 to 2012, Erika worked at the Colorado Governor’s Energy Office, primarily assisting rural and mountain communities with implementing local energy projects.

Erika has lived in a handful of states and countries over the years and is glad to have returned to Colorado. With many mountain vices available to her now, she enjoys life in the Roaring Fork Valley, where she can trail-run, ski, and camp.

Lawrence (“Larry”) is Of Counsel to Balcomb & Green. His practice focuses on general real estate and commercial law, and he advises clients on all aspects of business, contract and construction law, and related litigation. Larry has represented the developers of several of the Roaring Fork Valley’s largest residential and golf course communities and is a recognized expert in complex land use issues, including all aspects of residential and commercial real estate law.

Larry joined the firm of Delaney & Balcomb (now Balcomb & Green) in November, 1978 after graduating with honors from Gonzaga University School of Law in May of that year. He spent the first few years of his practice perfecting his skills as an attorney by assisting Kenneth Balcomb, one of the founders of the firm, primarily in the areas of water and real estate law. In 2015, Larry became “Of Counsel” to the firm that has borne his name since 1998. He is still active with the firm and regularly available to work with the firm’s clients and other attorneys on complex and sophisticated legal issues within his areas of expertise.

Scott is a partner at Balcomb & Green who helps clients enhance and protect valuable assets. He represents governmental entities, corporations, private property owners, developers, ranchers, golf courses and ski resorts on development and protection of water supplies throughout the state. He can assist in a wide array of matters, from the permitting of wells to adjudicating complex augmentation plans and ensuring those water rights are protected into the future. Aside from water law, Scott also works with buyers and sellers in real estate transactions drafting and negotiating contracts and assisting in the due diligence review. He often works with clients to resolve property disputes, such as boundary and easement issues between competing landowners.

Scott's focus is on the amicable resolution of disputes. He is well-liked by clients and able to negotiate effectively in disputes. When matters cannot be settled, Scott uses his trial and appellate experience. Scott has tried water and land use disputes and successfully argued before the Colorado Supreme Court. He has also appeared on numerous occasions before various levels of government arguing for the rights of property owners. Before moving to Glenwood Springs, Scott clerked for the Honorable Michael Bender on the Colorado Supreme Court and worked in the Office Legislative Council for the Colorado General Assembly.

Scott's community involvement includes Chairman of the City of Glenwood Springs’ Financial Advisory Board, President of the local United Way Chapter, and coaching ski and soccer programs. He also gives presentations to real estate groups and attorneys. Scott is married with three sons.

David is a partner at Balcomb & Green with an extensive water law background whose practice currently focuses within the Colorado River basin with some activity in the Front Range and Eastern Slope river basins. David’s work has been varied within the field of water law, including several significant cases and his continuing position as a special counsel for the Colorado River Water Conservation District (CRWCD).

David started law school at the University of Denver in 1977. While in law school he clerked at a small oil and gas law firm and then at a larger firm with a small water law practice where he developed an interest in property law and litigation. After graduating from DU in 1980, David worked as an associate attorney at Calkins Kramer Grimshaw & Harring. He was in a small water law practice and conducted “trials” in the South Platte River water court. He then moved to Saunders Snyder Ross & Dickson (SSR&D) in Denver.

In 1993, David became in-house general counsel for Colorado River Water Conservation Board and moved to Glenwood Springs. As CRWCD general counsel, he became familiar with much of Colorado’s Western Slope and its water users and water leaders. He then became water attorney for Eagle County, Lake County, the City of Fountain, Upper Yampa Water Conservancy District and others, and represented Public Service Company as a special counsel in a major change of South Platte River rights that culminated in an important Colorado Supreme Court decision.

David was born in 1955 in Enid, Oklahoma and raised in northern New Mexico where his father, the only medical doctor in the county at one time, exposed him to hunting and fishing. David became a debater at Guymon High School and attended Oklahoma Panhandle State University on a debate scholarship.

Thomas (“Tom”) is a partner at Balcomb & Green whose practice focuses on private and commercial real estate matters and general commercial legal representation of small and mid-size businesses throughout Western Colorado. He represents clients and development projects in a variety of Western Slope areas with an emphasis in the Roaring Fork and Colorado River regions from Glenwood Springs/Garfield County to Aspen/Pitkin County and Grand Junction/Mesa County.

Tom earned his law degree from the University of Denver College of Law where he graduated as a member of the Order of St. Ives. After interning with Kelly, Stansfield & O’Donnell during law school, Tom accepted an Associate position with the firm in downtown Denver, Colorado where he worked in the real estate and litigation departments for three years. Benjamin M. Johnston

Ben is an associate member of Worrell . Durrett . Gavrell, the firm’s litigation division, and also practices in the area of business law and real estate law. His practice has a primary focus on business, real estate, and personal injury disputes. His clients' range from individuals and businesses involved in local lawsuits to Fortune 50 corporations engaged in national class actions. Through his multifaceted practice, Ben has experience prosecuting and defending claims in state and federal courts across the country, including claims for breach of contract, fraud, breach of fiduciary duties, consumer protection violations, negligence, strict liability, and many others. He also has experience successfully managing post-trial appeals in both state and federal appellate courts.

Before joining Balcomb & Green, Ben built a foundation for his practice working in all levels of the legal system. He spent four years with a global-law-firm in Kansas City managing commercial and products liability litigation in various state and federal courts. He also spent time in New York City working at a global-law-firm where he handled mergers & acquisitions and counseled clients on corporate governance, securities laws, and financial regulations. Ben developed criminal trial experience while working as a prosecuting attorney for the City of St. Louis and gained extensive appellate knowledge while clerking for the Chief Justice of the Missouri Supreme Court.

He has over a decade of experience representing landowners, business owners, developers, buyers, sellers, homeowners associations, and investors in purchase and sale transactions and development of all types of real estate, including commercial residential, and investment. He also represents landowners and developers in land use entitlement acquisition from, and defense against, local jurisdictions, including Garfield County, Glenwood Springs, Carbondale, Basalt, Pitkin County, and Aspen.

Chad’s transactional experience includes representation of business owners in mergers and acquisitions, including asset purchase and stock purchase agreements. He also represents lenders and borrowers in the negotiation of loan agreements. Within the oil and gas industry, Chad assists operators, oil and gas companies, and landowners in mineral title examination and conveyance services in and around Glenwood Springs, Colorado's Western Slope, and Wyoming.

Chad is an enthusiastic and effective communicator and is skilled at negotiating real estate and business deals in Glenwood Springs, Garfield County, and neighboring jurisdictions. David Myler


David is the sole-practitioner associated with The Myler Law Firm a division of Balcomb & Green. His practice focuses on real estate, business services, and natural resources law. In 2013, he achieved a Peer Rating of AV Preeminent, the highest rating from Martindale-Hubbell, placing him among the top 15% of attorneys in the United States.

David moved to Snowmass Village in 1979 to become the Town’s first General Counsel. He authored the Town’s first Land Use Code and its Home Rule Charter and engineered the annexation of the Snowmass ski area. He began his private practice in the 1980s with a continuing emphasis on the land use development process and real estate transactions from Aspen to New Castle.

David has worked on many of the Roaring Fork Valley’s premier developments. He served as Special Counsel for the Cities of Aspen and Glenwood Springs on affordable housing matters, was a Board Member and Chairman of the Aspen/Pitkin County Housing Authority, and is a current Board Member and Past Chairman of the Colorado Housing and Finance Authority.

Eric Joined the firm in 2016, as the newest member of Worrell . Durrett . Gavrell, the firm’s litigation division. Eric's practice focuses primarily on litigation, contract disputes, real estate, creditor-debtor rights, family law, and insurance. He works in both the firm’s Glenwood Springs and Aspen offices. Prior to joining Balcomb & Green, he practiced in Scottsdale, Arizona and Seattle, Washington. He has represented a wide variety of clients, from injured and disabled workers, to large banks and insurance companies.

Born and raised in Telluride, Colorado, Eric understands the unique business and social culture of Western Colorado. He focuses on providing his clients with effective, compassionate advocacy, and understands that small communities magnify the need for disputes to be resolved creatively. Although his legal career has focused primarily on litigation, he is proudest of the cases that have settled without the expense and anguish of trial.

Timothy (“Tim”) is a partner at Balcomb & Green, P.C. whose primary area of practice is real estate with an emphasis on land use entitlements at local, state and federal levels.

After graduating from the University of Colorado Law School in 1988, he resumed employment with Mid-Continent Resources, Inc., first as an underground coal miner and then as a legal assistant in defense numerous Mine Safety and Health Administration citations, orders and civil penalties. At that time, Mid-Continent Resources was represented by Ed Mulhall and Robert Delaney of the law firm Delaney & Balcomb, P.C now Balcomb & Green, P.C. He joined Balcomb & Green in 1990 where his father, John Allen Thulson, had been an attorney since 1963.

Primarily working out of the firm's Aspen office, Lucas maintains a multifaceted transactional and litigation practice with a focus in the areas of business and real estate law. He has extensive civil litigation experience in a variety of legal matters, particularly in business and real estate disputes. His litigation experience provides valuable perspective to his transactional practice, such as structuring transactions to avoid pitfalls that often lead to litigation. As co-chair of Balcomb & Green's litigation division, Lucas helps steer the efforts of a team of five lawyers and two staff, all of whom are dedicated to professional and quality conflict resolution in whatever form and forum is required.

Lucas’ experience with real estate transactions in Aspen and throughout the Roaring Fork Valley includes the purchase and sale of residential, ranch, and commercial real estate.
